Obchodní podmínky

Prosíme čtěte pečlivě!

Rezervací místa na akci účastníci potvrzují, že se seznámili se všemi informacemi týkajícími se vstupenek, cen a dalších relevantních záležitostí na webových stránkách festivalu Fly to the Moon (Fly to the Moon_cz – swingville.cz) a že všechny jimi uvedené informace jsou pravdivé.

Obecné

V rámci našeho e-shopu (rezervačního systému) si můžete rezervovat, objednat a zakoupit vstupenku na celou akci, doprovodné workshopy, služby a související zboží.

Všichni účastníci obdrží náramek podle zakoupené vstupenky a taneční úrovně. Tento náramek budete muset nosit po celou dobu. Náramek je vaším vstupem na lekce a tančírny.

Na místo konání tančíren, kde je k dispozici plně funkční bar s nápoji a občerstvením, si nesmíte přinést vlastní jídlo ani nápoje s vyjímou vody.

Organizátoři nenesou žádnou odpovědnost za cennosti účastníků ani za jejich fyzická zranění. Buďte prosím za všech okolností opatrní, a to jak na sebe, tak na ostatní a na své věci.

Na lekce a na místech konání tančíren noste prosím pouze vhodnou vnitřní obuv.

Účastníci nesmí během lekcí nahrávat ani fotografovat, pokud to instruktoři nepovolí.

Organizátoři festivaluFly to the Moon si vyhrazují právo v případě potřeby změnit program akce, učitele a další.

Etické záležitosti

Organizátoři nebudou tolerovat žádné formy obtěžování, které mohou zahrnovat urážlivé slovní komentáře, sexuální obrázky ve veřejném prostoru, úmyslné zastrašování, pronásledování, sledování, obtěžující fotografování nebo nahrávání, trvalé narušování tanečních workshopů nebo jiných akcí, nevhodný fyzický kontakt a nežádoucí sexuální pozornost, jakékoli formy rasismu nebo diskriminace podle pohlaví, sexuální orientace, náboženství nebo národnosti.
Každý, kdo se dopustí tohoto typu chování, bude varován a/nebo vyloučen z festivalu bez náhrady, a to podle uvážení organizátorů.
Vyzýváme každého, kdo zažil nebo byl svědkem zastrašujícího nebo nevhodného chování, aby to sdělil organizátorům nebo zaměstnancům festivalu Fly to the Moon. Jsme vám k dispozici.

Od účastníků se očekává, že podpoří přátelskou a bezpečnou atmosféru festivalu slušným a uctivým chováním k ostatním účastníkům a učitelům a dodržováním hygienických návyků, zejména v případě tance Shag (používáním antiperspirantu a ručníků, výměna dostatečného počtu triček, svěží dech a čisté ruce atd.).

Uzavření smlouvy

Smlouvu s Námi je možné uzavřít pouze v českém jazyce. Překlad zajišťuje překladač.

Smlouva je uzavírána na dálku prostřednictvím E-shopu (rezervačního systému), přičemž náklady na použití komunikačních prostředků na dálku hradíte Vy. Tyto náklady se však nijak neliší od základní sazby, kterou hradíte za používání těchto prostředků (tedy zejména za přístup k internetu), žádné další náklady účtované Námi tedy nad rámec Celkové ceny nemusíte očekávat. Odesláním Objednávky souhlasíte s tím, že prostředky komunikace na dálku využíváme.

K tomu, abychom mohli Smlouvu uzavřít, je třeba, abyste na E-shopu vytvořili Objednávku. V tomto návrhu musí být uvedeny následující údaje:

• Informace o nakupovaných službách a zboží (na E-shopu označujete služby a zboží, o jehož nákup máte zájem, tlačítkem „Rezervovat“);
• Informace o Ceně a způsobu platby Celkové ceny; tyto informace budou zadány v rámci tvorby Objednávky v rámci uživatelského prostředí E-shopu, přičemž informace o Celkové ceně budou uvedeny automaticky na základě Vámi zvolných služeb a zboží.
• Své identifikační a kontaktní údaje sloužící k evidenci rezervace a informování o nastálých změnách, zejména tedy jméno, příjmení a e-mailovou adresu.

V průběhu tvorby Objednávky může až do doby jejího dokončení údaje měnit a kontrolovat. Po provedení kontroly prostřednictvím stisku tlačítka „Objednat“ Objednávku dokončíte. Před stiskem tlačítka musíte ale ještě potvrdit Vaše seznámení se a souhlas s těmito Podmínkami, v opačném případě nebude možné Objednávku dokončit. K potvrzení a souhlasu slouží zatrhávací políčko. Po stisku tlačítka „Objednat“ budou všechny vyplněné informace odeslány přímo Nám.

Vaši Objednávku Vám v co nejkratší době poté, kdy Nám bude doručena, potvrdíme zprávou odeslanou na Vaši e-mailovou adresu zadanou v Objednávce. Součástí potvrzení bude shrnutí Objednávky a tyto Podmínky formou přílohy e-mailové zprávy. Podmínky ve znění účinném ke dni Objednávky, tj. ve znění přiloženém jako příloha potvrzující e-mailové zprávy, tvoří nedílnou součást Smlouvy. Potvrzením jednotlivých rezervací v rámci zaslané Objednávky dochází k uzavření Smlouvy mezi Námi a Vámi.

V případě, kdy dojde k uzavření Smlouvy, Vám vzniká závazek k zaplacení Celkové ceny.

Platební a dodací podmínky

Za účast na festivalu a na jednotlivých workshopech, tančírnách a doprovodných službách platíte účastnický poplatek. Výše ceny poplatku je uvedena u každé nabízené služby včetně DPH v rámci našeho e-shopu a v návrhu Objednávky. Celková cena je uvedena včetně DPH včetně veškerých poplatků stanovených zákonem. Platbu Celkové ceny po Vás budeme požadovat po uzavření Smlouvy a před čerpáním služeb. Úhradu Celkové ceny můžete provést následujícími způsoby:

• Bankovním převodem. Informace pro provedení platby Vám zašleme v rámci potvrzení Objednávky. V případě platby bankovním převodem je Celková cena splatná do 3 dnů.
• Kartou online. V takovém případě probíhá platba přes platební bránu ComGate, přičemž platba se řídí podmínkami této platební brány, které jsou dostupné na adrese: https://www.comgate.cz/smluvni-dokumenty. V případě platby kartou online je Celková cena splatná do 3 dnů.

Aktuální výši účastnického poplatku včetně případných slev najdete na našem webu a rovněž vždy pro každý kurz zvlášť v prostředí rezervačního formuláře na webu. Výše ceny uvedená na webu během rezervace může být dále snížena o slevu. Konečná výše ceny (se započtením případných slev) je uvedena na našem portálu při zobrazení rekapitulace nové objednávky. Pokud jsme se spletli a na webu zobrazovaná či v platebních údajích uvedená výše účastnického poplatku je zjevně chybná, vyhrazujeme si právo na odstoupení od Smlouvy.

Účastnický poplatek může být snížen o slevu dle aktuální nabídky slev uvedených na našem webu. Sleva se kumuluje s jinými slevami na webu, pokud není uvedeno jinak. Sleva se aktivuje během rezervace. V případě, že dojde ke zrušení již zaplacené rezervace, která množstevní slevu aktivovala, odpadne Vám nárok na danou slevu a vyzveme Vás k doplacení ceny (původně snížené o vybranou slevu).

V případě, že dojde k akceptaci Vaší rezervace více než 4 dny před posledním dnem období rezervací na festival, bude kurzovné splatné do 3 dnů od zaslání platebních údajů. Pokud dojde k akceptaci rezervace 4 dny a méně před posledním dnem rezervace na kurz, bude kurzovné splatné do druhého dne od zaslání akceptace rezervace. Na blížící se termín splatnosti Vás budeme upozorňovat e-mailem.

K zaplacení účastnického poplatku dojde okamžikem připsání platby řádně označené dle platebních údajů na bankovní účet Swingville z.s.

Po zaplacení účastnického poplatku Vám zašleme e-mailem informace o přijetí platby a finálním potvrzením vašich rezervací. Doklad o zaplacení a poskytnutí služby Vám pošleme, pokud nás o to požádáte e-mailem.

Objednané služby je možné následně čerpat v době a místě konání festivalu, které jsou uvedeny na našich webových stránkách nebo v rámci našeho e-shopu (v rezervačním systému). Vámi rezervované a zakoupené fyzické zboží bude vám vydáno na místě v době konání festivalu na základě doložení potvrzení o zaplacení.

Storno podmínky

Pokud se účastník rozhodne registraci zrušit, část ceny, která mu bude vrácena, závisí na datu zrušení registrace:

• V případě zrušení rezervace před 1. březnem bude vráceno 80 % ceny nákupu.
• Při zrušení rezervace po 1. březnu a před 1. dubnem vám bude vráceno 60% ceny nákupu.
• V případě zrušení rezervace po 1. dubnu nelze uhrazené peníze vrátit. V případě závažných důvodů (např. zdravotních) budou náhrady posuzovány individuálně.

Za jakékoli požadované vrácení peněz je účtován dodatečný administrativní poplatek ve výši 5 % z ceny nákupu.

Zakoupené rezervace jsou přenosné. V případě, že se po zakoupení vstupenek nebudete moci festivalu zúčastnit, kontaktujte nás a doporučujeme vám pokusit se vstupenku prodat:

• Pokud jste se zaregistrovali jako „follower“, můžete svůj průkaz prodat POUZE jinému „followerovi“.
• Pokud jste se zaregistrovali jako „leader“, můžete svůj průkaz prodat POUZE jinému „leaderovi“.
• Vstupenky a další nákupy nelze převést na další ročník festivalu.
• Pokud svou vstupenku prodáte, dejte o tom co nejdříve vědět organizátorům.

Pořadatelé festivalu Fly to the Moon si vyhrazují právo akci kdykoli zrušit. V takovém případě uhradíme 100 % ceny vašich rezervací zpět.

V případě, že registrace musí být zrušena z důvodu platných právních omezení (např. během pandemie, války apod.):

• Pokud účastníkovi není umožněn vstup na festival z důvodu úředních omezení, nabízíme vrácení 75 % vstupného nebo převod vstupenky na jiný ročník. Pošlete nám e-mail a požádejte o vrácení peněz s dokladem o příslučných opatřeních a právními informacemi.
• Pokud organizátoři budou muset akci zrušit, vrátíme vám 75 % ceny vstupenky nebo umožníme převod vstupenky na jiný ročník festivalu.

Ochrana osobních údajů

Záleží nám na ochraně vašich osobních údajů. Vámi poskytnuté údaje používáme pouze pro účely organizace festivalu. Údaje jsme získali přímo od vás prostřednictvím registračního systému. Vaše údaje uchováváme pouze po určitou dobu stanovenou zákonem a na vaši žádost je neprodleně vymažeme. K těmto údajům mají přístup Pojďme dělat město, z.s., jimi pověření zaměstnanci a externí poskytovatel registračního systému. Údaje spravují organizátoři a vedení spolku. Vaše údaje nejsou poskytovány žádnému jinému subjektu. Shromažďujeme následující informace: Registrace na festival – jméno a příjmení a e-mailová adresa. V případě jakýchkoli dotazů nebo přání vymazat své osobní údaje z naší databáze nás prosím kontaktujte na info@swingville.cz .

Účastník se může objevit na fotografiích nebo videích pořízených organizátorem nebo jeho zástupcem. Pořadatel může tato média použít k jakýmkoli účelům souvisejícím s festivalem Fly to the Moon nebo k jiným uměleckým účelům jakékoli formy. Účastníci souhlasí s tím, že tato média jsou výhradním vlastnictvím pořadatele. Pokud si nepřejete být fotografováni, kontaktujte nás prosím na info@swingville.cz .

Terms of service

Please read this carefully.

By registering for the event, participants confirm they have read all the information regarding passes, prices and other relevant issues at the Fly to the Moon website (Fly to the Moon_cz – swingville.cz) and all the information provided by them is true.

General

Within our e-shop (booking system) you can book, order and purchase tickets for the whole event, accompanying workshops, services and related goods.

All participants will receive a wristband according to the ticket purchased and dance level. You will be required to wear this wristband at all times. The wristband is your entry to classes and dance classes.

You may not bring your own food or beverages, except water, to the dance venue, which has a fully functioning bar with drinks and snacks.

The organisers accept no responsibility for participants‘ valuables or physical injuries. Please be careful at all times, both of yourself, others and your belongings.

Please wear only appropriate indoor footwear to classes and dance venues.

Participants may not record or take photographs during lessons unless instructors give permission.

The organizers ofFly to the Moon reserve the right to change the event schedule, teachers, etc. if necessary.

Ethics Policy

The organisers will not tolerate any form of harassment, which may include offensive verbal comments, sexual images in public spaces, deliberate intimidation, stalking, surveillance, harassing photography or recording, persistent disruption of dance workshops or other events, inappropriate physical contact and unwanted sexual attention, any form of racism or discrimination based on gender, sexual orientation, religion or nationality.
Anyone guilty of this type of behaviour will be warned and/or expelled from the festival without refund, at the discretion of the organisers.
We encourage anyone who has experienced or witnessed intimidating or inappropriate behaviour to report it to the Fly to the Moon organisers or festival staff. We are at your disposal.

Participants are expected to promote a friendly and safe atmosphere at the festival by being polite and respectful to other participants and teachers and by observing good hygiene habits, especially in the case of Shag dancing (using antiperspirant and towels, changing enough t-shirts, fresh breath and clean hands, etc.).

Contract closing

The Contract with Us can only be concluded in the Czech language. The translation is provided by a translator.

The Contract is concluded remotely via the E-shop (reservation system), and the costs of using remote communication means are paid by You. However, these costs do not differ in any way from the basic rate that You pay for using these means (in particular, for Internet access), so You do not have to expect any additional costs charged by Us beyond the Total Price. By submitting the Order, You agree that We use remote communication means.

In order to conclude the Contract, You must create an Order on the E-shop. This proposal must include the following information:

Information about the purchased services and goods (in the E-shop, you mark the services and goods that You are interested in purchasing by clicking the „Book“ button);
Information about the Price and method of payment of the Total Price; This information will be entered when creating an Order within the user environment of the E-shop, while information about the Total Price will be automatically provided based on the services and goods you have selected.
Your identification and contact information used to record the reservation and inform you about permanent changes, in particular your name, surname and e-mail address.

During the creation of the Order, you can change and check the data until its completion. After checking, you will complete the Order by pressing the „Order“ button. Before pressing the button, however, you must confirm your familiarity with and agreement to these Terms and Conditions, otherwise it will not be possible to complete the Order. A check box is used for confirmation and agreement. After pressing the „Order“ button, all completed information will be sent directly to Us.

We will confirm your Order to you as soon as possible after it is delivered to Us by a message sent to your e-mail address specified in the Order. The confirmation will include a summary of the Order and these Terms and Conditions as an attachment to the email message. The Terms and Conditions in effect on the date of the Order, i.e. as attached as an attachment to the email message confirming the Order, form an integral part of the Contract. Confirmation of individual reservations within the sent Order concludes a Contract between Us and You.

In the event that a Contract is concluded, You are obligated to pay the Total Price.

Payment and delivery terms

You pay a participation fee for participation in the festival and in individual workshops, dance halls and accompanying services. The amount of the fee is stated for each offered service, including VAT, in our e-shop and in the Order proposal. The total price is stated including VAT, including all fees stipulated by law. We will request payment of the Total Price from you after concluding the Contract and before using the services. You can pay the Total Price in the following ways:

By bank transfer. We will send you information for making the payment as part of the Order confirmation. In the case of payment by bank transfer, the Total Price is payable within 3 days.
By card online. In this case, payment is made via the ComGate payment gateway, and the payment is governed by the terms and conditions of this payment gateway, which are available at: https://www.comgate.cz/smluvni-dokumenty. In the case of payment by card online, the Total Price is payable within 3 days.

The current amount of the participation fee, including any discounts, can be found on our website and also for each course separately in the booking form on the website. The price stated on the website during the reservation may be further reduced by a discount. The final price (including any discounts) is stated on our portal when displaying the summary of the new order. If we have made a mistake and the amount of the participation fee displayed on the website or in the payment details is clearly incorrect, we reserve the right to withdraw from the Contract.

The participation fee may be reduced by a discount according to the current offer of discounts stated on our website. The discount is cumulative with other discounts on the website, unless otherwise stated. The discount is activated during the reservation. In the event that an already paid reservation that activated the quantity discount is canceled, you will no longer be entitled to the given discount and we will ask you to pay the additional price (originally reduced by the selected discount).

If your reservation is accepted more than 4 days before the last day of the festival reservation period, the course fee will be due within 3 days of sending the payment details. If your reservation is accepted 4 days or less before the last day of the course reservation period, the course fee will be due by the second day after sending the reservation acceptance. We will notify you of the approaching due date by email.

The participation fee will be paid when the payment, duly marked according to the payment details, is credited to the Swingville z.s. bank account.

After paying the participation fee, we will send you information by email about the receipt of payment and the final confirmation of your reservations. We will send you a proof of payment and service provision if you request it by email.

The ordered services can then be used at the time and place of the festival, which are listed on our website or within our e-shop (in the reservation system). The physical goods you have reserved and purchased will be issued to you on site at the time of the festival upon presentation of proof of payment.

Cancellation Policy

If a participant decides to cancel their registration, the amount of the refund depends on the date of cancellation:

In case of cancellation before March 1st, 80% of the purchase price will be refunded.
In case of cancellation after March 1st and before April 1st, 60% of the purchase price will be refunded.
In case of cancellation after April 1st, the money paid cannot be refunded. In case of serious reasons (e.g. health reasons), refunds will be assessed individually.

An additional administrative fee of 5% of the purchase price will be charged for any requested refund.

Purchased reservations are transferable. In case you are unable to attend the festival after purchasing tickets, please contact us and we recommend that you try to sell your ticket:

If you registered as a „follower“, you can ONLY sell your pass to another „follower“.
If you have registered as a „leader“, you can ONLY sell your pass to another „leader“.
Tickets and other purchases cannot be transferred to the next festival year.
If you sell your ticket, please let the organizers know as soon as possible.

The Fly to the Moon festival organizers reserve the right to cancel the event at any time. In such a case, we will refund 100% of the price of your reservations.

In case the registration has to be canceled due to applicable legal restrictions (e.g. during a pandemic, war, etc.):

If the participant is not allowed to enter the festival due to official restrictions, we offer a 75% refund or transfer of the ticket to another year. Please send us an email and request a refund with proof of the relevant measures and legal information.
If the organizers have to cancel the event, we will refund 75% of the ticket price or allow the ticket to be transferred to another year of the festival.

Data Privacy

We care about the protection of your personal data. We use the data you provide only for the purposes of organizing the festival. We have obtained the data directly from you through the registration system. We store your data only for a certain period of time stipulated by law and will delete it immediately upon your request. Poďme dělí město, z.s., its authorized employees and the external provider of the registration system have access to this data. The data is managed by the organizers and the management of the association. Your data is not provided to any other entity. We collect the following information: Festival registration – first and last name and e-mail address. In case of any questions or wish to delete your personal data from our database, please contact us at info@swingville.cz .

The participant may appear in photographs or videos taken by the organizer or its representative. The organizer may use these media for any purposes related to the Fly to the Moon festival or for other artistic purposes of any form. Participants agree that these media are the exclusive property of the organizer. If you do not wish to be photographed, please contact us at info@swingville.cz.
